Important positioning rule. These Site Terms are intentionally strict about professional boundaries. The website, state-law pages, checklists, sample artifacts, webinars, downloads, and program-review conversations are framed as informational and operationally assistive only. They do not create legal, tax, accounting, audit, attest, certification, insurance, or regulatory-advisory obligations.
Scope; relationship to other agreements
These Website Terms of Use (these “Site Terms”) govern access to and use of the public Borealis Security websites, public and gated downloadable resources, request forms, scheduling pages, security and privacy pages, state-law resource pages, and other public or marketing-facing online properties made available by Borealis Security, Inc. (“Borealis,” “we,” “us,” or “our”). These Site Terms apply only to visitor and public-site use. They do not replace any signed services agreement, order form, Aurora Command clickwrap, Trust Center terms, data processing addendum, or other separate written agreement that expressly governs paid services, a customer workspace, a reviewer portal, or controlled procurement sharing. If a link takes you into Aurora Command, a customer workspace, a Trust Center access flow, or another area governed by separate accepted terms, those separate terms control to the extent of any conflict.
Eligibility; acceptance; business use
By accessing or using the website, you acknowledge that you have read and understood these Site Terms and agree to be bound by them to the maximum extent permitted by applicable law. If you do not agree, do not use the website. You may use the website only if you are legally capable of forming a binding contract and, where you act on behalf of an entity, you are authorized to act for that entity. The website is intended primarily for business and professional use, not for personal, family, or household use.
Limited license
Subject to these Site Terms, Borealis grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to access and use the website solely for lawful internal evaluation of Borealis and its offerings. No right is granted to copy, reproduce, frame, mirror, republish, scrape, data-mine, train models on, sell, exploit, create derivative works from, or distribute the website or its content except as expressly permitted in writing by Borealis.
Professional boundaries; no legal, tax, accounting, audit, or certification advice
Borealis is a cybersecurity and governance implementation firm. Borealis is not a law firm, CPA firm, licensed public accounting firm, certification body, attestation provider, external auditor, insurer, managed security operations provider, or regulator. The website, sample materials, framework pages, state-law summaries, implementation checklists, walkthroughs, calls, meetings, and downloads are educational and operationally assistive only. They may be generalized, incomplete, stale, or unsuitable for your organization, reviewer, legal obligations, accounting treatment, tax posture, insurance position, or regulatory facts. You are solely responsible for obtaining independent legal, tax, accounting, audit, regulatory, and technical advice; validating the applicability, completeness, and currentness of any information; implementing controls; and determining whether your organization satisfies any law, regulation, framework, contract, questionnaire, insurer requirement, or reviewer expectation. Borealis does not promise that any public content, sample artifact, checklist, mapping, or recommendation will make you compliant, review-ready, certifiable, insurable, or acceptable to any auditor, buyer, assessor, carrier, regulator, or other third party.
Aurora Command handoffs; client login; linked systems
Borealis may link to Aurora Command, customer workspaces, reviewer packages, or other controlled systems. Those linked environments may have separate privacy notices, cookie notices, AI notices, reviewer terms, and customer agreements. Borealis may deliberately open certain Aurora links in a new tab or separate surface to make the handoff visible and reversible. You are responsible for reviewing the applicable terms and notices for any linked system before using it.
Prohibited conduct
You must not use the website or any downloadable materials for unlawful, deceptive, infringing, defamatory, harassing, abusive, competitive-intelligence, benchmarking, automated-scraping, model-training, or security-testing purposes. You must not attempt to access data that is not yours, bypass permissions, introduce malicious code, interfere with website availability, impersonate another person, misrepresent your affiliation, or submit information you lack authority to disclose. You must not rely on the website as a substitute for your own validation, legal review, accounting review, tax review, auditor guidance, or regulator-specific analysis.
Forms, submissions, and requested materials
If you submit questionnaires, screenshots, draft evidence, notes, deadlines, operating-state details, or similar materials through the website or in connection with a program review, you represent that you have the right to disclose them for that purpose. You remain responsible for reviewing your submissions for privileged material, highly sensitive regulated data, prohibited data categories, and any information that you are not authorized to disclose. Borealis may reject, redact, return, or delete submissions that it reasonably believes create legal, security, privacy, sanctions, export-control, or operational risk.
Intellectual property; downloadable materials; feedback
The website and its contents, including text, graphics, workflows, sample materials, state-law resource structures, screenshots, compilations, and overall look and feel, are protected by intellectual-property and proprietary-rights laws. Unless Borealis expressly states otherwise in writing, downloadable materials are provided for your internal informational use only. You may not republish, resell, white-label, modify for external distribution, or remove legends or attribution from those materials. If you provide feedback, suggestions, corrections, or ideas regarding the website or Borealis offerings, Borealis may use them without restriction or compensation, except to the extent prohibited by law.
Privacy; cookies; communications
Your use of the website is also governed by the Borealis Security Privacy Policy, Notice at Collection, Cookie Policy, and Privacy Choices page, each as updated from time to time. If you provide contact information, Borealis may use it to respond to your request, schedule meetings, send the specific materials you asked for, operate the relationship, send service or transactional communications, and, where permitted, send marketing communications subject to applicable law and your choices.
Changes; availability; suspension
The website and all public materials are provided on an “as available” and “as is” basis. Borealis may update, change, limit, suspend, or discontinue any page, feature, download, resource, sample, or offering at any time, with or without notice. Borealis may suspend or block access to protect security, prevent abuse, comply with law, investigate misuse, address suspected fraud, or protect customers, partners, or third parties.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE, ITS CONTENT, AND ALL PUBLIC OR GATED MATERIALS ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WITHOUT LIMITING THE FOREGOING, BOREALIS DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, QUIET ENJOYMENT, AND RESULTS. BOREALIS DOES NOT WARRANT THAT THE WEBSITE OR ANY PUBLIC CONTENT WILL BE COMPLETE, CURRENT, ERROR-FREE, SECURE, UNINTERRUPTED, SUITABLE FOR YOUR NEEDS, OR ACCEPTED BY ANY CUSTOMER, AUDITOR, ASSESSOR, INSURER, REGULATOR, OR OTHER THIRD PARTY.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOREALIS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, DEALS, DATA, GOODWILL, REPUTATION, INSURANCE BENEFITS, AUDIT OR ASSESSMENT OUTCOMES, CERTIFICATIONS, REGULATORY STATUS, OR REMEDIATION COSTS, ARISING OUT OF OR RELATING TO THE WEBSITE OR YOUR RELIANCE ON ANY PUBLIC CONTENT. IF, NOTWITHSTANDING THESE SITE TERMS, BOREALIS IS FOUND LIABLE TO YOU FOR A CLAIM ARISING ONLY FROM PUBLIC-SITE USE and not from a separate signed or clickwrapped agreement, BOREALIS’S AGGREGATE LIABILITY WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). If your claim relates to paid services, a paid Aurora Command workspace, reviewer portal access under customer direction, or a separate written agreement, the liability provisions in that separate agreement control instead of this Section.
Indemnity
You will defend, indemnify, and hold harmless Borealis and its officers, directors, employees, contractors, affiliates, licensors, and service providers from and against claims, demands, losses, liabilities, damages, judgments, settlements, penalties, fines, costs, and expenses (including reasonable attorneys’ fees) arising from or related to your misuse of the website, your violation of these Site Terms, your unlawful or unauthorized submissions, your infringement of another party’s rights, or your breach of law.
Governing law; venue; jury waiver
These Site Terms and any dispute arising out of or relating to them or the website will be governed by the laws of the State of Alaska, without regard to conflict-of-laws principles. Exclusive jurisdiction and venue for any dispute not subject to a separate signed arbitration agreement will lie in the state or federal courts located in Anchorage, Alaska, and each party irrevocably submits to those courts. TO THE MAXIMUM EXTENT PERMITTED BY LAW, EACH PARTY WAIVES ANY RIGHT TO A JURY TRIAL IN ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATING TO THESE SITE TERMS OR THE WEBSITE.
Miscellaneous
These Site Terms constitute the entire agreement between you and Borealis regarding public-site use, unless and until a separate signed or clickwrapped agreement applies. If any provision is held unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. Borealis may assign these Site Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets. You may not assign or transfer your rights or obligations without Borealis’s prior written consent. No third-party beneficiaries. These Site Terms are solely for the benefit of Borealis and the person or entity using the public website. No prospect, referral recipient, customer, reviewer, auditor, insurer, regulator, or other third party is an intended beneficiary of these Site Terms.
